The Metaverse and its impact on the State and sovereignty

This paper analyzes the nature of the Metaverse from a technical and legal perspective. This state-of-the-art digital service aims to provide incredible experiences in dreamlike places never before explored, as well as to feel presence, perform quasi-physical activities and develop new businesses and sectors that are currently being defined. The study then examines the legal challenges, risks, and opportunities that the Metaverse brings. In particular, it looks at its impact on the very existence of the State and its sovereignty. Metaverses concentrate quasi-normative, executive and judicial powers, which gives the corporations that manage and commercially exploit them a particularly authoritarian position, concentrating remarkable power in their hands. They have created an autonomous paralegal order that recognizes rights, identifies prohibitions and regulates user liability. This special legal position poses urgent challenges to constitutional law, which are analyzed in this paper.
