Abstract:
Nowadays the use of Assisted Reproduction Techniques has resulted in some unresolved problems and issues not expressly addressed by a lacking constitutional regulation in these matters. This essay focuses on one dimension, the so-called surrogate motherhood which has gained considerable importance and has now become particularly topical due to ECtHR case law, inconsistent with the judicial solution that has been given to this issue in Spain. On the other hand, such a legislative reform, essential to incorporate into national law
the correct interpretation of the fundamental rights affected by that interpretation imposed from the conventional sphere, has not been
carried out to date.
