Abstract

Abstract
This paper deals with the study of the numerous dissenting opinions present in the decision of the Spanish Constitutional Court that in 2013 invalidated
the special legal status granted to the catholic universities in Spain’s Law by
the 2001 Universities Act. Extensive consideration is here give to the meaning
of the main conceptions common to those dissenting opinions, and particularly
to the notion of the so called «proportional equality», traditionally developed by certain scholars with the aim to justify the different legal treatment given in Spain’s Law to the different denominations and now also present in most of those above mentioned dissenting opinions.
