Abstract:
The rulings handed down in recent years by the Court of Justice of the European Union, in response to preliminary rulings on the adequacy of the rules applicable in the Spanish legal system to achieve the objectives set out in the Directive 93/13 on unfair terms in consumer contracts, highlight the opposition of some of the rules analyzed to the Directive. This moves the obligation of results for the
courts and gives rise in practice to the existence of different criteria of interpretation before identical factual premises, to the detriment of purported legal certainty that ensures the confidence of consumers in the hiring.
