AbstractRight to education can be defined as the right to form in and freedom one’s consciousness. Their full enjoyment of this right by infants and children may lead conflicts regarding the right of parents to choose their moral and religious education in the childhood. Controversial situations should be judgment by national authorities according to the margin of appreciation doctrine of the ECHR about the scope and of the Human Rights established in the first Additional Protocol of the Rome Convention.
