Abstract

A study of appeal guarantees in the second instance of criminal proceedings, as interpreted by the case law of both the ECHR and the SC, demonstrate their incompatibility with the current legal regime, with the result that the regulation of the Spanish criminal appeal system is a mere formality, devoid of content, which is reason enough for urgent legislative reform.
