Abstract

The popular election of judges, far from representing an attempt to deepen democracy, is yet another step in the simulated construction of the legal-constitutional order, which from the seat of power seeks to cleanse before public opinion what is nothing more than a crude attempt to dominate dissent and expand the spoils to be distributed among a governing elite that lords over what remains institutionally in a country terrorized by crime. In such a context of social and constitutional disruption, circles close to power attempt to present as doctrinal and rational elaborations positions that are politically indefensible and legally absurd, such as the one commented on here by Professor Juan Antonio García Amado, which allows Tribuna Constitucional to cast an eye on the troubling Mexican situation.
