The new paradigm of vindictive sexual law: Why is it necessary to «deconstruct» the gender perspective?

Abstract

Spanish legislation on crimes against sexual freedom has gone through different stages with well-defined characteristics, such as the protection of honesty, the protection of sexual freedom and, recently, the occurrence of the case of «La Manada» and the current political situation made possible the irruption of the gender perspective in this matter. In this work are exposed the pillars on which the gender theory is based and thebenefits of this new way of understanding the protection of sexuality in the Spanish Penal Code are questioned.
