La noción de presunción más allá del Derecho

Resumen: Es bien conocido que las presunciones juegan un papel de gran importancia en el campo del Derecho. Ahora bien, tal vez no lo es tanto que presunción es una noción que se estudia con un valor en cierta medida diferente más allá de las fronteras de esta disciplina, en campos como la Teoría de la Argumentación, la Epistemología y la Pragmática. En este artículo nos proponemos, de un lado, ofrecer una visión general de qué se entiende por presunción en dichos campos de estudio y, de otro, dar unas pinceladas acerca de su vinculación con la noción jurídica.
Abstract: It is common knowledge that presumptions play a paramount role within the field of Law. Nonetheless, it may not be widely known that presumption is a notion that is studied with a partly different meaning beyond the boundaries of this subject, in fields of knowledge such as Argumentation Theory, Epistemology and Pragmatics. In this paper we aim to briefly present what presumption stands for in these fields of knowledge and give some hints on the way in which these uses are related to the legal notion.
