Abstract

The article explains the position of Council of State with regards to the constitutionality of the Market Unity Guarantee Act 20/2013 of 9 December. According to its opinion, the new regulation doesn’t cause a variation of distribution power rules between State and Autonomous Communities. The partially dissenting opinion of Council for Statutory Guarantees of Catalonia has also been included.
