Abstract

Freedom of artistic creation includes the liberty to disseminate artistic works. The protection of the artistic expression is related with the possibility of distinguishing fiction and reality. This paper studies the possibilities and limits of the art as a protected speech in Spain, taking into account the examples of France, Germany and the European Court of Human Rights
