Tentativa inacabada, tentativa acabada y desistimiento

Abstract

A pesar de que la doctrina y la jurisprudencia asumen una estricta vinculación entre tentativa inacabada y desistimiento pasivo, por un lado, y tentativa acabada y desistimiento activo, por otro, es necesario tener en cuenta que la delimitación entre las formas de tentativa es una cuestión que debe resolverse en sede de injusto, mientras que en materia de desistimiento priman las consideraciones político-criminales. Ello conduce a la ruptura de las citadas correlaciones, por ejemplo, en los casos en que el sujeto, tras algún fracaso previo, puede perseguir todavía la consumación.

A strict link between uncompleted attempt and passive renunciation of criminal purpose is assumed by both judges and scholars. They also accept such correlation between completed attempt and active renunciation of criminal purpose. However, the proper boundaries of the criminal attempt must be assessed within the legal real of the criminal behavior, whereas the role of renunciation of criminal purpose depends upon political considerations. This idea challenges the mention correlations in cases in wich the subject, after a failed attempt, might still be able to pursue the consumption of the crime
