Los delitos de omisión de los mandos militares y superiores civiles ante la comisión de crímenes internacionales en el Código penal español

Abstract

La armonización del Estatuto de la Corte Penal Internacional con el Código penal español motivó la inclusión del artículo 615 bis en el Derecho penal común. A través de esta norma, se incorporaron al ordenamiento jurídico-penal tres delitos de omisión diferentes de diverso alcance y gravedad entre los Delitos contra la Comunidad Internacional, cuyos destinatarios son los mandos militares y los superiores civiles. A la interpretación del artículo 615 bis se dedican las páginas siguientes intentado ofrecer una explicación coherente de estos delitos con el artículo 28 del Estatuto de la Corte Penal Internacional del que trae causa. La importancia de esta interpretación es extraordinaria también para los tribunales militares españoles, puesto que, en el enjuiciamiento de crímenes internacionales, deberán aplicar el artículo 615 bis del Código penal común.

The harmonisation of the Rome Statute of the International Criminal Court with the Spanish Criminal Code led to the inclusion of article 615 bis in the Spanish Criminal Law. Through this norm, three crimes of omission of different scope and severity were included in the criminal system between the Crimes against the International Community, whose addressees are the military commanders and other superiors. The following pages are dedicated to the interpretation of article 615 bis, trying to offer a coherent explanation of these offenses with article 28 of the Statute of the International Criminal Court that it derives from. The importance of this interpretation is also extraordinary for the Spanish Military Courts, since, in the prosecution of international crimes, they must apply article 615 bis of the Criminal Code.
