Politization of Justice, judicialization of politics: State of the question in Spain

The politicization of Justice and the judicialization of politics are perceived by citizens as serious deviations from the ideal of separation of powers designed by Montesquieu. But the incarnation of the ideal of separation of powers was different in the United States of America, where judicial review of the constitutionality of laws was admitted from the beginnig, and in France and in the European countries that followed, such as Spain, where it was implemented a bureaucratized judicial career hijacked by the Executive Branch through the political occupation of high judicial positions and a system of iron discipline. The transition from the liberal rule of law to the constitutional rule of law has meant a substantial change in the conception of the judicial function, from the mouth that speaks the law to that of the guardian of promises. The Judicial Branch gains prominence over the Legislative Branch. In this new context of the constitutional rule of law, the study analyzes the situation in Spain in relation to the judicialization of politics (judicial control of legislative processes; demand for responsibilities from political officials; complaints of «lawfare») and in relation with the politicization of Justice (which has led to an institutional degradation of General Council of the Judiciary). Finally, the purposes of the CGPJ renewal Pact reached by the majority parties are analyzed and especially if the Pact has meant an improvement for the present and, above all, for the future.
