This paper analyzes the Sentence of the Provincial Court of Barcelona dated 9 September 2024, which condemns for the third time the owner of the Europa bookstore in Barcelona for selling books and other materials of Nazi ideology. This is the first sentence that applies the provision specifically intended to punish the denialist phenomenon since the reform of the Spanish Penal Code in this matter by LO 1/2015, art. 510.1. c). The analysis focuses on two key issues. First, in the Court’s refusal to raise a question of unconstitutionality regarding the types of art. 510.1, and, second, in the criteria adopted as the basis for the sentence.
