El nuevo régimen de prestaciones o medidas en la suspensión: artículos 80.3 y 84 del código penal

La reforma operada por la LO 1/2015, de 30 de marzo, ha eliminado la sustitución de la pena de prisión y, en su lugar, ha optado por la introducción del régimen de suspensión-sustitución, en los arts. 80.3 y 84 (y 85) CP. Varias son las cuestiones controvertidas que han surgido como consecuencia de esta reforma y que repercuten de manera directa en su operatividad. Entre las más importantes cabe citar la naturaleza de las denominadas legalmente prestaciones o medidas y las pautas orientadoras de la decisión judicial a favor de la aplicación del régimen de la suspensión-sustitución, bien porque se opte por la modalidad excepcional de suspensión prevista en el art. 80.3 CP, bien porque se opte por el régimen general de suspensión-sustitución del art. 84 CP aplicable a las restantes modalidades de suspensión mencionadas en el art. 80 en los apartados 2, 4 y 5 CP.
The reform introduced by the LO 1/2015, of March 30th, eliminated the replacement of the prison sentence and, in its place, it chose for the introduction of the suspension-replacement system, in the arts. 80.3 and 84 (and 85) CP. There are different controversial questions that have arisen as a result from this reform and that reverberate in a direct way in the operation capacity of the reform. One of the most important aspects is the nature of the measures and the rules that guide the judicial decision in favor of the application of the suspension-replacement system, either because it is decided in favor of the exceptional form of suspension (art. 80.3 CP), or because it is decided in favor of the suspension-replacement general system of the art. 84 CP applicable to the remaining forms of suspension mentioned in the art. 80, in the paragraphs 2, 4 and 5 CP.
