Challenges to the Right to Health Protection in the Process towards its Digitalization: Equity, Sustainability and Progressivity

A study from a constitutional perspective of the recognition of the right to health protection,
according to the perspective of the right to healthcare, based on three principles or references that we consider
iconic: equity, sustainability and progressivity or prohibition of regressivity. Based on an analysis of the concerns of citizens and professionals in the exercise of the right, its consolidation as digital health will be addressed. In the study of equity, its territorial dimension will be studied, the mutualist dimension, focusing on the problems of Muface, and the personal dimension, addressing the criteria for exclusion from health care.
The analysis of sustainability will reflect on the financing of healthcare and the challenges to which it must
respond. Digitalisation of health will be the reference point for the principle of progressivity, studied from the
perspective of the new rights regulated by Regulation (EU) 2025/327 of the European Parliament and of the
Council, of 11 February 2025, on the European Health Data Space
