There are hardly any case-law precedents of commercial bribery convictions or acquittals (Criminal Code, article 286 bis). The recent acquittal issued in the so-called ‘Neymar II case’ (Barcelona Provincial Court Judgment, Section 6, of December 12th, 2022), although it is not final yet, allows us to assess the current state of the matter. Through the review of the most debatable aspects of this judgment, it is reviewed the eventual impact that this case-law precedent will have on the future interpretation of this still novel criminal offence.
