Abstract

The nature of the obligation of the physician has been rated unanimously by the doctrine and the jurisprudence as media, i.e. that which is integrated by the correct professional activity, and not a concrete result. However, the emergence of so-called medicine voluntary, such, that front the healing, does not have a therapeutic purpose, has completely changed this traditional approach, in favor of that, in these cases, the physician has an obligation of result, among whose specialities, is dentistry, which involves one major qualification required difficulty, to attend some of their treatments, both purposes, curative and aesthetic. This study analyzes the foundation legal on which they rest these approaches, and dispute with the analysis of the distinction between the two types of obligations and with contradictory decisions dictated by our courts on the issue.
