Sale and returns policy

The present Conditions may be modified at any time, which will be informed to the Subscriber by ordinary mail, e-mail or notice on the subscription website owned by REVISTA DE PSIQUIATRIA Y PSICOLOGIA HUMANISTA SL.

1. OBJECT

The purpose of this document is to establish the terms and conditions that will govern the contractual relationship between Revista de Psicoterapia and the reader who becomes a Subscriber when the latter contracts a subscription.

2. CONTRACTING MODALITIES

The reader may contract the subscription to the Revista de Psicoterapias that best suits his or her needs via the Internet.

The Subscriber declares that each and every one of the data and information provided to Revista de Psicoterapia are true, and Revista de Psicoterapia reserves the right to not allow the contracting of any subscription (in the case of not having registered yet) or to cancel the subscription in question without the possibility of any refund and this contract being automatically terminated, to any Subscriber who has provided false data, without prejudice to the actions that may be applicable by law.

Likewise, the Subscriber declares that he/she knows and accepts, in their entirety, the Conditions that will govern between the parties after contracting a subscription with Revista de Psicoterapia.

3. CONTRACTING

Only persons over 18 years of age may contract subscriptions with Revista de Psicoterapia, in their own name and right or in the name of the legal entity they represent with sufficient power of attorney. It is forbidden to contract a subscription to Revista de Psicoterapia by any natural or legal person whose usual activity is the sale of magazines (hereinafter referred to as the "Points of Sale"). Revista de Psicoterapia reserves the right to automatically terminate the Contract with those persons who fail to comply with this premise or who do not comply with the requirements established in these Conditions.

4.- SHIPPING, RETURNS AND EXCEPTIONS
 
Shipments are made automatically once the subject has accepted the purchase order. The download link will be sent to the e-mail address with which you have registered.
The Revista de Psicoterapia undertakes to refund the purchase price if, due to any technical problem, the subject has not been able to download his/her purchase.

No product will be refunded if it does not meet the user's expectations.

 5. FEES AND PAYMENTS

The prices of the different subscription modalities can be consulted on the Website.
 
The Subscriber must pay the corresponding price by credit or debit card, which is generally charged at the beginning of the subscription period. The Subscriber agrees to pay for the subscription to the Journal of Psychotherapy and accepts that, in the event that it is not possible for the Journal of Psychotherapy to invoice and/or collect the amounts owed by the Subscriber, the Subscription will be cancelled and therefore, the present Contract will be automatically terminated.
 
6. RIGHT OF WITHDRAWAL
 
All Subscribers who have the status of consumers and users, according to Law 3/2014, which amends Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, shall have the right to withdraw from the contracted subscription within fourteen (14) calendar days of the Subscriber obtaining the possibility of enjoying the contents of their subscription.
 
To exercise the right of withdrawal, Subscribers must notify Revista de Psicoterapia by means of a statement clearly and unequivocally stating their desire to withdraw, to the address indicated below:

You should only complete and send this form if you wish to withdraw from the contract.
 
The completion of this form is not a prerequisite for exercising the right of withdrawal.
 
In the event that the Subscriber exercises his/her right of withdrawal, Revista de Psicoterapia will refund the proportional part of the amount paid, corresponding to the remaining period of the subscription.
 
7. NON-FULFILMENT AND TERMINATION
 
In case of non-fulfilment of the present Contract by the Subscriber, Revista de Psicoterapia will be entitled to terminate the same, without the possibility of reimbursement, in the event that the Subscriber has made any payment. Furthermore, in case of non-payment, Revista de Psicoterapia reserves the right to take the necessary legal measures in order to comply with the pecuniary obligations derived from the Subscription contract.
 
In the event of non-fulfilment of the present Contract by Revista de Psicoterapia, due to an incident that has not been resolved, the Subscriber will be entitled to terminate the same, and Revista de Psicoterapia will undertake to return the amount of the proportional part of what had been paid corresponding to the remaining period of the subscription.
 
8. CANCELLATION OF SUBSCRIPTION
 
The Subscriber may proceed to unilaterally cancel the subscription at any time during its validity. Such cancellation shall not entail, under any circumstances, the reimbursement of the amounts paid by the Subscriber in consideration for the subscription to the Revista de Psicoterapia. These amounts are non-refundable.
 
To request the cancellation of the subscription, the Subscriber must communicate his/her request clearly and unequivocally to Revista de Psicoterapia through the channels made available for this purpose:

- Ordinary mail addressed to REVISTA DE PSICOTERAPIA calle Madrazo, 113, entresuelo 2ª 08021 Barcelona.
 
In the event that Revista de Psicoterapia decides to cancel any service for business or other reasons other than breach by the Subscriber of any of these Terms and Conditions, it shall notify the Subscriber who is affected, with reasonable notice, in order to give him/her the opportunity to cancel the subscription if he/she so wishes, without any additional cost to the Subscriber. In the event that this happens, Revista de Psicoterapia will refund the Subscriber the amounts corresponding to the remaining subscription period.

9. INTELLECTUAL PROPERTY
 
All the contents of the Revista de Psicoterapia (hereinafter, the "Contents") are the exclusive property of Revista de Psicoterapia or it holds the exploitation rights over them through agreements with third parties. The contents constitute works protected by the legislation on Intellectual Property and therefore may not be reproduced, distributed, transformed or communicated publicly in any form, except for personal use by the Subscriber.
 
By virtue of the foregoing, the Subscriber may not duplicate, sell, resell or exploit the copies or their Contents in any way. The Subscriber agrees to know and respect the reservation of these rights made by Revista de Psicoterapia. Revista de Psicoterapia reserves the right to take appropriate legal action against those who violate this clause.
 
10. APPLICABLE LAW AND JURISDICTION
 
The present Conditions will be interpreted and governed according to the Spanish legislation. Revista de Psicoterapia and the Subscriber undertake to try to resolve, in an amicable manner, any disagreement that may arise in the development of the contracted service, prior to going to court. To this end, the parties, expressly waiving any jurisdiction that may correspond to them, submit to the courts of the Revista de Psicoterapia's domicile.
 
Online Dispute Resolution Platform: In compliance with the provisions of European Union Regulation 524/2013 of 21 May 2013 on online dispute resolution in consumer matters, we inform you that the European Commission provides you with an online platform for the extrajudicial resolution of online disputes, which is available at the following link: http://ec.europa.eu/consumers/odr/, through which you can process any complaint about online claims made within the territory of the European Union.

11. PROTECTION OF PERSONAL DATA:
 
11.1 Data controller
The personal data provided by the Subscriber will be included in a file under the responsibility of REVISTA DE PSIQUIATRIA Y PSICOLOGIA HUMANISTA SL with address at calle Madrazo, 113, entresuelo 2ª 08021 Barcelona.
 
11.2 Purposes and lawfulness of processing
 
11.2.1 Necessary purposes for the management of the subscription contract
The Subscriber's data shall be processed for the following purposes necessary for the management of the subscription contract and/or the benefits associated with the same:
 
- Management, collection and delivery of the subscription.
 
o Distributors, if their services are necessary for the delivery of the subscription.
 
11.2.2 Legitimate purposes
In addition, unless the Subscriber objects, their data will be processed for the following purposes:
 
- Pre-registration on the Website for validation of your email address and enjoyment of the benefits associated with the subscription. If you do not confirm your registration, your data will be deleted from the website within 1 month.
 
11.3 Processing period
The processing indicated above will be carried out for as long as the subscription is valid. Thereafter, the data will cease to be processed for these purposes and will be kept for 5 years to cover any liabilities arising from the processing.
 
11.4 Rights
At any time, the Subscriber may exercise their rights of access, rectification, deletion, opposition, limitation and portability through postal mail to Revista de Psicoterapia providing a photocopy of your ID card or equivalent document and identifying yourself as a subscriber of Revista de Psicoterapia.
 
Likewise, if the Subscriber considers that his/her rights have been violated, he/she may file a complaint with the Spanish Data Protection Agency (www.agpd.es).
 
11.5 Subscriber Guarantees
 
The Subscriber declares that:
- He/she is over 18 years of age and has no limited legal capacity.
- Each and every one of the data provided is accurate and truthful.
- In the event of providing data of third parties to Revista de Psicoterapia, he/she has informed said third parties of everything contained in this document and has obtained their authorisation.
