Abstract

In this paper the thesis supported by Ridao-Gonzalez is refuted. Thus it is argued that the secessionist claim of the Catalan nationalist secessionist is contrary to the values and principles that underpin the European Union and its Member States, that secession is contrary to the Constitution and because the Union law, is exclusive, is antisocial and may not be peaceful. And to that extent, the prohibition of a secessionist consultation and secession itself, which would be a major fracture of Catalan society far from violating Article 2 of the Treaty on European Union would preserve the principles and values enshrined in that Article. Furthermore it is argued that in case the secession of a territory of the Spanish State, would take place the seceded state would be automatically excluded from the European Union and its possible incorporation into the same depends, in any case, on the will of every one of the Member States of the Union. Solutions outside of Articles 48 and 49 of the Treaty on European Union are not possible.
