The essay seeks to explore and highlight the reinsertion potential of the application of Restorative Justice actions in the Penitentiary Treatment of the inmates of the Penitentiary Institutions, as well as the inclusion of the interests of the victims and their needs in the search for a definitive solution to the social conflict arising from the crime. The differentiation between Criminal Mediation and Restorative Penitentiary Treatment, as well as the distinction between reparable damage in criminal proceedings and the damage suffered by the victim, should be the starting point for the design and application of concrete and specific actions aimed at overcoming the damage caused by the criminal action.
