Abstract

It has now emerged a new constitutional paradigm in the Mexican state where the activist attitude on the part of the judiciary is patented for control of conventionality ex officio, it is clear that the fold causes are still making the old mistakes of science procedural, primitive and full of strife and overcome conflict of interest, based on notions are all contentious judicial process cognition, it still claims that the procedural test, intended to find the truth and utilitarianism causes the discontinuation of procedural rules and thus the human right to due process was violated, to safeguard human rights, go paradox.
