Abstract

It has been the confiscation, one of the rare cases of the inquisitorial literature in which content can give a possible privileged procedure that makes possible the abuse of the inquirers and the commission of all luck of arbitrarinesses. This work puts us in precedents of the importance of this procedural instrument since it is the confiscation of goods, for the attainment of the ends exercised by the organism entrusted to chase the heresy. In relation to the material location of our object of study, it is necessary to specify that, inside the inquisitorial studies of procedural character, a monograph does not consist at present, but only you index, that approaches the examination of the confiscation of real estate on the part of the exchequer of the Spanish Inquisition from a historical - juridical point of view. For the study of this work, we have studied in the manuscripts of the National Library. With regard to the procedural practice of the courts and of the Advice, we have investigated in the Historical National File. Later they confronted with the funds of the court of the Inquisition of Cuenca, guarded in the Diocesan File of Cuenca.
