Comments, available on the defence of child victims of gender violence, under Draft Law on Child Protec

Abstract

The Draft Law on Children Protection, approved by the Council of Ministers on April 25,2014, has important legislative reforms that Protect children victims of gender violence. This legislative reform aims to integrate into the Spanish’s legal system in defense of the best interests of the child as interpretative principle, substantive law and rule of procedure as recommended by UN in 2013. IT’S also feels necessary in cases of gender violence to take preventive measures in order to protect affected children. This reform establishes the consideration of children as direct victims of gender violence in any case, and the determination to pursue in cases of children who suffer domestic violence to stay with their mothers, regardless of age. Throughout this article we will analyze Draft´s legislative reforms affecting children in cases of gender violence in an attempt to give them an extrasafety and security due in cases of gender violence.
