Abstract

 Several members of the Italian doctrine consider that destination and segregated liability are distinct concepts. The acts of destination, regulated by art. 2645 ter of the Italian Civil Code, and the «patrimonio especialmente protegido» are then compared. In the first case, the bond of destination engraved on goods, in order to achieve an interest worthy of protection, leads to segregated liability. In the second case, however, the destination bond does not result in separation, understood as a limitation of patrimonial responsibility. The theme of responsibility will then be analyzed in either institution.
