The Conservation of Paleontological Heritage in the Regulatory Context in Castilla-La Mancha (Spain)

The apparent similarity between the extraction techniques, as well as the study of past materials, seems to be what has marked the unity of the Paleontological and Archaeological Heritage in cultural regulations. However, we must take into account the differences between them and that their unity in the legislation can cause legal defencelessness in some cases due to the lack of adjustment to the specific needs of each type of Property.
To carry out this study on the protection of a material as sensitive as Paleontological Heritage, the norms and protection figures approved by the international and national conventions on Cultural and Natural Heritage have been examined; as well as the Castilian La Mancha regional legislation and the professional codes have been revised.
The conclusion that has been reached is that there is a clear lack of definition in the different legislations that negatively affects the Paleontological Heritage. Consequently, it is necessary to enact those laws and regulations that adjust to the specific characteristics of said heritage to legally guarantee adequate protection and conservation of it.
