El Consejo Europeo y sus relaciones con las demás instituciones de la Unión

Abstract

La incorporación del Consejo Europeo como «nueva» institución en el marco institucional de la Unión Europea suscita interrogantes y polémicas. Casi cada reforma de los Tratados provoca el debate sobre si ha pesado más la intergubernamentalidad o, por el contrario, se ha profundizado en la integración dando mayor peso a aquellas instituciones, como el Parlamento Europeo o la Comisión, que no defienden los intereses de los Estados miembros. En este artículo, el Consejo Europeo y su relación con las demás instituciones de la Unión sirve de test para afirmar el escoramiento intergubernamental de la Unión, como defienden la mayoría de los autores, o negarlo. El Consejo Europeo no introduce ninguna novedad que no estuviera ya presente, de hecho o de derecho, en la Unión Europea. Por ello, todo sigue igual que estaba.

The consideration of the European Council as a new institution within the institutional framework of the European Union raises some questions and controversies. Almost each reform of the European Treaties causes a debate on whether intergovernmentality prevails over integration or, on the contrary, the reform deals with the integration in depth, lending greater weight to those institutions, like the European Parliament or the Commission, which do not defend the interests of the Member States. In this paper, the European Council and its relationship with the other European Union institutions are testing to evaluate whether it represents a shift towards a more intergovernmental approach to European integration, as most commentators maintain. However, the European Council does not introduce any new features, either in fact or in law, in the European Union. For this reason, everything is the same as it used to be.
