Today we are faced with a binomial that much of Spanish youth considered indissoluble: alcohol and driving. For a while now, the phenomenon of the «botellón» among youth has become the way of life of many generations. This, coupled with the current possibility of buying a car soon after obtaining the driving licence and the traditional Spanish custom of drinking alcohol during the weekends and in the majority of social events is doing to increase the road accidents in which a large percentage of the injured had consumed alcohol or drugs before driving. The problem is that law and the Spanish alcoholic tradition going by different paths. The legislation tries to be restrictive by applying even the criminal law to eradicate drunk driving, while the society is more tolerant with the consumption of alcohol at the wheel. The majority of the population believes that you must administratively punish drivers moving under the influence of alcohol or drugs, but only should criminally condemn the most extreme road situations. In this situation the legislature puts society faced a dilemma: drinking alcohol and using drugs on weekends and at social events without driving automobiles or strengthen preventive controls and eradicate the bottle through its prohibition to detect drunk driving and proceed to its sanction even in criminal matters.
