Changes in our society in recent decades, caused largely by globalization, the crisis of the welfare state and the economic crisis has resulted in the emergence of new situations under the name of «social exclusion» are related to crime, including poverty, inequality, marginalization, race, ethnicity, immigration, gender, inequality, increasingly affecting a substantial number of people are included, which generates a feeling or sense uncertainty for citizens who are not in that situation, which leads them to ask the State to take action against these groups or individuals. The state, with increasing frequency, resorted to criminal law to solve these social problems, rather than adopting social integration policies.
