Abstract

The common policy of the railway transportation in the European Union finds its constitutional origin in the Title IV of tbe Rome Treated (1957). Since tben, tbe operator companies in this sector have been, mainly, public companies, most of tben monopolistic character. These companies bave had large deficits, supported by aids and/or public subsidies, as well as with polices centered in the national strategic and social environment. This framework has lasted until 1991, a period in which numerous regulations have been issued in order to regulate and to liberalize the transport market. The new directives show tbe need to increase tbe safety and reliability in thls type of transport as a result of tbis liberalization, so much the safety of the passengers and workers, trying to avoid with these regulations tbe disastrous consequences after this liberalization in other countries (like the United Kingdom).
